A judge has declared a mistrial in the case of a former Seabrook, New Hampshire, police officer accused of assaulting a man by slamming him into a wall.
The jury could not reach a verdict Tuesday against Mark Richardson.
Richardson was charged with assault after video surfaced showing him pushing Michael Bergeron into a wall at the Seabrook Police Station in 2009.
Bergeron had been charged with driving while intoxicated and possession of drugs.
The mistrial does not necessarily mean Richardson is in the clear.
Defense Attorney Peter Perroni said, “We continue to maintain our innocence. We just had a week-long jury trial. The jury carefully considered the evidence now we have to wait and see what the AG does next and we'll respond to that."
Assistant Attorney General Geoff Ward said, "The court will generally put the case back on the docket reschedule it for some time down the road and consider where to go from here."
Three other officers were disciplined following the incident.
