Man Facing Charges in Deadly Jamaica Plain Crash

A Massachusetts appeared in court Friday to face charges in connection with a deadly crash last week in Boston's Jamaica Plain neighborhood.

Police arrested Joseph Kayode, 32, of Lynn, and charged him with homicide by motor vehicle while operating under the influence.

Kayode was arrested following an investigation of an early morning, two-vehicle crash on Dec. 22 when officers responded to the intersection of Columbus Avenue and Heath Street.

Upon arrival, the occupant of one vehicle, 56-year-old Emanuel Cabral, of Boston, was pronounced dead at the scene.

Five other victims were transported to area hospitals to be treated for injuries.

Police said investigators determined that Cabral's death was caused by Kayode. A prosecutor said Kayode's blood alcohol level was .13 and speed may have been a factor in the crash.

Kayode’s attorney told the judge his client feels sorry for what happened. 

Cabral‘s wife and two sons were in court wearing pins with his photo. Their attorney told NBC Boston that Cabral recently arrived in this country from Cape Verde. He was on his way to work a job cleaning stores when the crash happened. He was the passenger and his brother-in-law was the driver. The brother-in-law remains in a hospital with serious injuries. 

A funeral for Cabral was held Thursday. 

The crash investigation is still ongoing. Prosecutors are waiting to review electronic data and the reconstruction report. 

Kayode’s bail was set at $7,500 and the judge ordered him to report to probation one time a week and remain alcohol-free. 

He will be back in court Jan. 30 for a hearing.
