Mass. Breathalyzer Errors Impact OUI Cases

Officials confirm that 22 OUI tests in Worcester County were impacted by errors in Breathalyzer testing that have affected cases throughout Massachusetts.

District Attorney Joseph Early Jr. confirmed that 15 of those defendants had already been notified, and that the other seven were in the process of being told.

Early added that the cases would "be handled with the best interests of justice."

"Defense attorneys who handled the affected cases will be given an option to proceed with a motion for a new trial," said Early in a statement. "Appropriate decisions will be made on a case by case basis."

Days earlier, it was determined that "fewer than 150" cases were deemed to be invalid across the state.

Worcester County will begin using breath test results in court again after suspending use of the process two weeks ago.
